NextGen Integrated Practice Bank
The NextGen integrated practice bank has one set for each doctrinal module. Every set combines doctrine with issue recognition, selected response, written analysis, investigation, and practical advice. The goal is flexible lawyering performance, not isolated rule recognition. One integrated set exists for each of the 213 doctrinal modules, so the client-file practice always maps back to a specific rule you can review in its own outline entry. Each set runs the same five tasks in sequence, issue recognition, selected response, written analysis, investigation, and practical advice, because a real client matter rarely arrives as a single isolated question. Progress is saved on this device, and results feed the same coverage index the study dashboard reads, alongside the interactive lessons and question bank.
Federal-question jurisdiction
Civil Procedure · Federal judicial power
A patient sues a drug manufacturer under state negligence law and alleges that violation of a federal labeling rule proves breach. The federal statute creates no private action.
Supplied legal resources
R1Apply the well-pleaded-complaint rule; ignore anticipated defenses and federal counterclaims.
R2A federal ingredient must appear in the plaintiff's properly pleaded claim.
R3Declaratory-judgment actions are analyzed by asking whether the coercive action would arise under federal law.
R4A private federal cause of action usually suffices; an embedded issue requires the narrower substantial-federal-question test.
Boundary note
!A federal defense never supplies ordinary federal-question jurisdiction.
!A complaint cannot manufacture jurisdiction by artful reference to federal law.
Identify the primary issue, governing legal test, and the two most legally significant facts.
How to work an integrated set on the NextGen UBE
An integrated set on the NextGen UBE starts from a client file, so read the whole file before you look for a rule. Mark the parties, the dates and the client's stated goal, because the goal decides which issues matter and which are noise. Then list the issues you see without writing anything, and only after that open the selected-response questions.
The selected-response questions test whether you can apply a rule under time pressure, so answer them before you check your issue list against the module outline. The written analysis comes next: state the rule from memory, apply it to the facts in the file, and reach a conclusion the client can use. Do not restate the file; the reader already has it.
The investigation and advice tasks are where most candidates lose points, because they ask what to do next instead of what the law is. Name the one fact you would still need, say how you would get it, and give advice that fits the client's goal even when the rule points the other way. Finish by comparing your work with the model analysis for the module and logging each miss as a missed rule, a missed fact or a missed step.
| Task | What it checks |
|---|---|
| 1 · Issue recognition | Can you find every governing issue inside one client file? |
| 2 · Selected response | Can you apply a rule under exam time pressure without writing it out? |
| 3 · Written analysis | Can you produce a complete rule-to-fact analysis in your own words? |
| 4 · Investigation | Can you identify what fact is still missing before advising anyone? |
| 5 · Practical advice | Can you turn the analysis into an answer a client could actually use? |
